Justice Arach’s burial Update: Court to rule on Tuesday

Judge Keturah Kitariisibwa Katunguka of the high court to pass ruling on the burial dispute of the late Justice Arach on Tuesday, June 27, 2023, when the family Division of the high court in Makindye will give its final verdict on where the late Supreme Court judge Stella Arach Amoko will be laid to rest.

“Having listened to submissions from the two disputing parties, the court ruling will be delivered by mail to the parties and their lawyers before the closure of business on Tuesday,” said Katunguka.

Katunguka issued an injunction restraining any party or their agents from removing the body from A-Plus Funeral Home in Mengo, where it is currently being kept until the court rules on the matter.

A Dispute erupted after her death between her husband and the justice’s family members when either side wanted her buried on their side.

The Justice’s family members insist she should be buried at Jukia Hill next to her father in Juba village, Nebbi District, and according to the family members, it was her dying wish.

However, the Judge’s husband says she should be buried at his country home in Adjumani District or at a neutral ground at Arua District Catholic Cathedral Cemetery, a mission the family has declined.

Following the disagreement, the deceased’s children, through their lawyers, petitioned the family court to pass judgment on the matter. The family argues that she should be buried according to her deathbed wishes.

The Judge passed away on June 17, 2023, at Nakasero Hospital after battling cancer for a long time. She died intestate (a person who dies without writing a will), and this is in line with the Ragem clan customs, which supposedly bar royals from making a will.
